Welcome to Carolina Cloud! These Terms of Service ("Terms") govern your use of Carolina Cloud's cloud computing services, including virtual machines, containers, and related infrastructure services (the "Services"). By accessing or using our Services, you agree to be bound by these Terms.

1. Service Description

Carolina Cloud provides on-demand cloud computing resources including:

  • Virtual machines (VMs) with various CPU, RAM, and storage configurations
  • Container hosting and management
  • High-performance computing resources including GPU access
  • Network and storage infrastructure

2. Account Registration and Eligibility

2.1 Account Creation

To use our Services, you must create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials.

2.2 Eligibility

You must be at least 18 years old and have the legal capacity to enter into contracts. If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2.3 Account Security

You are responsible for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account.

3. Acceptable Use Policy

3.1 Permitted Uses

You may use our Services for legitimate business, educational, research, and development purposes, including but not limited to:

  • Web applications and software development
  • Data processing and analysis
  • Machine learning and AI research
  • Scientific computing and simulations
  • Educational projects and coursework

3.2 Prohibited Uses

You may not use our Services for:

  • Cryptocurrency Mining: Any form of cryptocurrency mining is strictly prohibited and will result in immediate account suspension and charges at full rates without trial credit benefits
  • Illegal Activities: Any illegal activities or activities that violate applicable laws or regulations
  • Malicious Software: Distributing malware, viruses, or other harmful code
  • Network Attacks: Conducting network scanning, penetration testing of systems you don't own, or denial-of-service attacks
  • Spam or Abuse: Sending unsolicited communications or engaging in abusive behavior
  • Copyright Infringement: Hosting or distributing copyrighted content without authorization
  • Resource Abuse: Intentionally consuming excessive resources in a manner that degrades service for other users

4. Trial Credits and Billing

4.1 Free Trial Credits

New users receive $1.00 in free trial credits to evaluate our Services. Additional trial credits may be available through our application process for legitimate business or educational use.

4.2 Payment and Billing

  • A valid payment method is required to access Services beyond trial credits
  • You will be billed for actual resource consumption based on our published rates
  • Storage costs continue to accrue for stopped resources until they are deleted
  • All charges are final and non-refundable unless otherwise specified

4.3 Resource Management

When trial credits are exhausted, your resources will be automatically stopped to prevent unexpected charges. You are responsible for monitoring your usage and managing your resources.

5. Service Availability and Support

5.1 Service Levels

While we strive to maintain high availability, we do not guarantee uninterrupted service. Scheduled maintenance may result in temporary service interruptions.

5.2 Data Backup

You are solely responsible for backing up your data. We recommend regular backups of important data and applications.

5.3 Support

We are committed to providing helpful and responsive support to all our users. Our support team will work diligently to address your questions and technical issues. While response times may vary based on the nature and complexity of your inquiry, we strive to respond to all support requests promptly during business hours.

6. Data and Privacy

6.1 Your Data

You retain ownership of all data you store on our Services. You are responsible for ensuring you have the right to use and store any data on our platform.

6.2 Data Security

We implement reasonable security measures to protect your data, but cannot guarantee absolute security. You should implement additional security measures as appropriate for your use case.

6.3 Data Retention

Data may be permanently deleted when resources are destroyed or accounts are terminated. We are not responsible for data loss.

7. Intellectual Property

Carolina Cloud retains all rights to our platform, software, and Services. You retain rights to your content and data. You grant us a limited license to host and process your content as necessary to provide the Services.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CAROLINA CLOUD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, REGARDLESS OF THE THEORY OF LIABILITY.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

9. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

10. Termination

10.1 Termination by You

You may terminate your account at any time by contacting us and deleting all your resources.

10.2 Termination by Us

We may suspend or terminate your account immediately if you violate these Terms, particularly the Acceptable Use Policy.

10.3 Effect of Termination

Upon termination, your access to the Services will cease, and your data may be deleted after a reasonable period.

11. Modifications to Terms

We may update these Terms from time to time. Continued use of the Services after changes are posted constitutes acceptance of the new Terms.

12. Governing Law

These Terms are governed by the laws of North Carolina, United States. Any disputes will be resolved in the courts of North Carolina.
